Estas condiciones regulan la adquisición de obras (cuadros y pinturas) ofrecidas a través de este sitio web. Dado que se trata de obras personalizadas realizadas por encargo, la compra no se formaliza mediante un carrito o pasarela de pago en la propia web, sino a través de contacto directo y correo electrónico, según el proceso que se describe a continuación. Al realizar un encargo, el cliente declara haber leído y aceptado estas condiciones.

2. Purpose and Nature of the Artworks

The artworks offered are original, bespoke creations, lovingly hand-painted by the artist in accordance with the details agreed upon with each client (subject matter, dimensions, technique, etc.). Due to their unique, handcrafted nature, subtle variations may occur compared to reference images displayed on the website or preliminary sketches. These variations are an intrinsic part of the artwork's artistic character and soul, and are not considered defects.

3. Purchasing Process

  1. Contact: the client gets in touch via the web form or by emailing info@diezdcuadros.com, sharing their artistic vision (ideas, references, approximate dimensions, desired timeframe).
  2. Estimate: the artist responds with a personalized estimate detailing the price, the characteristics of the artwork, the estimated completion time, shipping costs, and payment method.
  3. Acceptance: the commission is confirmed once the client accepts the estimate in writing (by email) and, where applicable, pays the agreed deposit. The contract is formalized at that moment, binding both parties to the terms set forth in the accepted estimate and in this document.
  4. Creation and shipping: once the artwork is completed and the outstanding balance is settled, it is carefully packed and dispatched.

4. Prices and Taxes

The price of each artwork is communicated individually within the estimate. Unless otherwise stated, prices are understood to be VAT included. Shipping costs are detailed separately in the estimate.

5. Payment Methods

Payment is made via [bank transfer / Bizum / other], as specified in the estimate. For commissioned pieces, a deposit or down payment may be requested upon confirmation, with the remaining balance due before the artwork is shipped.

6. Creation and Delivery Timeframes

The creation timeframe for each artwork is an estimate and is agreed upon in the quote, as it depends on the piece's complexity and the artist's current workload. Once the artwork is complete and full payment is received, the delivery time will depend on the carrier and destination. The artist will keep the client informed of any significant delays.

7. Shipping

  • Shipping scope: Spain.
  • Carrier: Correos Expréss.
  • Shipping costs: calculated based on the destination, dimensions, and weight of the artwork, and detailed in the estimate prior to confirmation.
  • Packaging: all artworks are carefully packed with protective materials suited to their delicate nature. We recommend arranging shipping insurance for high-value pieces; should you choose to do so, it will be detailed in the estimate.
  • Transmisión del riesgo: conforme al art. 66 ter del TRLGDCU, el riesgo de pérdida o deterioro se transmite al cliente cuando él o un tercero por él indicado (distinto del transportista propuesto por el vendedor) adquiere la posesión material de la obra. Cualquier incidencia en el transporte debe comunicarse en cuanto se reciba el paquete, conservando el embalaje.

8. Right of Withdrawal

De acuerdo con el artículo 103.c del Real Decreto Legislativo 1/2007 (TRLGDCU), el derecho de desistimiento no es aplicable a los bienes confeccionados conforme a las especificaciones del consumidor o claramente personalizados. Dado que las obras se realizan a medida y por encargo, el cliente no dispone del derecho a desistir una vez confirmado el encargo.

En el supuesto de que se adquiera una obra ya realizada y no personalizada (no confeccionada según indicaciones del cliente), sí será de aplicación el derecho de desistimiento de 14 días naturales desde la recepción, debiendo el cliente devolver la obra en perfecto estado y asumiendo los costes de devolución, salvo pacto en contrario.

9. Cancellation of Commissions

If the client cancels an already confirmed commission, the deposit or down payment may not be refundable if work on the piece has already begun, as it is a custom-made creation. If the cancellation occurs before work has started, the amount paid will be refunded minus, where applicable, the cost of materials purchased specifically for the commission.

10. Legal Guarantee of Conformity

Con independencia de lo anterior, el cliente consumidor dispone de la garantía legal de conformidad prevista en el TRLGDCU. Si la obra entregada no se corresponde con lo pactado en el presupuesto, presenta defectos no atribuibles a su carácter artesanal, o llega dañada por el transporte, el cliente debe comunicarlo lo antes posible a info@diezdcuadros.com para acordar la solución que corresponda (reparación, sustitución, rebaja del precio o reembolso, según el caso).

11. Intellectual Property

La venta y entrega de la obra transmite al cliente la propiedad del soporte físico, pero no los derechos de propiedad intelectual sobre la creación, que permanecen en todo caso en poder del artista, conforme al Real Decreto Legislativo 1/1996 (Ley de Propiedad Intelectual). En consecuencia, el cliente no queda autorizado a reproducir, comercializar o explotar la obra con fines comerciales sin el consentimiento expreso y por escrito del autor, quien conserva su derecho de paternidad sobre la misma.

El cliente consumidor dispone además de las vías ordinarias de protección: las hojas oficiales de reclamaciones, las Oficinas Municipales de Información al Consumidor (OMIC) y, con carácter voluntario, las Juntas Arbitrales de Consumo.

13. Legislación aplicable y jurisdicción

Estas condiciones se rigen por la legislación española. Para la resolución de cualquier controversia, y cuando el cliente tenga la condición de consumidor, será competente el órgano jurisdiccional correspondiente a su domicilio.
